Release and Waiver

The Hong Kong Junior Tigers hockey program is owned by the China Hockey Group (“CHG”).  By registering for any CHG program, you agree to the terms and conditions set forth in this release and waiver (“Release and Waiver”).

1.           Definitions

As used in this Release and Waiver the following terms shall have the following meanings:

“Releasees” shall mean CHG and all directors, officers, employees, consultants, agents, contractors, instructors, coaches, volunteers, sponsors, and representatives, and their respective successors and assigns, or any of them in connection with the operation of CHG Activities.

“Activities” means any sports, training or variations of athletic activities, including, but not limited to the following Ice Hockey, Floor Hockey, Ball Hockey, Inline Hockey and Ice Skating.

2.           Acknowledgement of Risks

I am aware that the Activities involve inherent risks, dangers and hazards, both known and unknown, that are associated with athletic training, development and competition. I understand that similar risks are also inherent in using equipment associated with the Activities, and any other devices, apparatus, or training facilities. I understand the risk of negligence on the part of the Releasees, including the failure on the part of them to take reasonable steps to safeguard or protect the participants from the risks, dangers and hazards, both known and unknown, of participating in the Activities. I acknowledge that personal harm or injury may be sustained during my/my child’s involvement in the Activities, including, but not limited to, broken bones, head / neck injuries, concussions, dislocations, tendon and ligament damage (including sprains), damage to teeth and dental work, spinal injuries (that could result in various degrees of paralysis), and death. I acknowledge and assume the potential risks and consent to my/my child’s participation in the Activities.

3.           Consent to Participation

I/my child have/has been informed that I/he/she is to abide by the rules and regulations including directions and instructions from the administrators, instructors, coaches, and supervisors as communicated to me/my child while participating in the Activities.  In the event that I/my child fails to abide by the rules and regulations, disciplinary action may be imposed, including at the discretion of CHG the banning from further participation in the Activities, in which case I/he/she will not be entitled to a refund of any fees paid.

I confirm that I/my child am/is in good health, and in proper physical condition to participate in the Activities.  It is my responsibility to notify the staff of any physical or mental concerns for me/my child which may affect my/my child’s participation in the Activities.

I acknowledge that the Activities may require an instructor, coach, employee, or supervisor to perform some manual spotting or instruction that involves direct physical contact with me/my child and are designed to assist the participant in the safe performance and execution of the skills.  I consent to such physical contact with me/my child.

4.           Release and Waiver

I confirm that I have read the above description of risks and understand the risks involved in participating in the CHG Activities. I confirm that I voluntarily and freely accept all such risks and choose to participate/allow my child to participate in the CHG Activities. I accept full responsibility for my own/my child’s actions.  In consideration of being allowed to participate in CHG Activities I hereby agree to waive any and all claims that I have or may have in the future against, and to release and discharge the Releasees from any and all liability, including but not limited to the following:

  • Personal injury
  • Death
  • Property damage
  • Any other loss, damage or expense

arising from any cause whatsoever, including negligence (including, but not limited to, negligence caused by my own actions or inactions, those of others participating in the Activities, the conditions in which the  Activities take place, or negligence of the Releasees), breach of contract, or breach of any statutory duty or other duty of care, on the part of the Releasees, and further including the failure on the part of the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of participating in CHG Activities.

5.           Indemnification

I agree to indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage or cost which the Releasee may incur as a result of a claim, brought by myself or anyone on my behalf, against any of the Releasees.

6.           Authorization of First Aid

I hereby authorize basic first aid to be delivered to me/my child by the Releasee’s staff or other authorities. By administering first aid when required or requested, the Releasee in no way warrants or assumes any liability in relation to the administration of such basic first aid.

I further understand and agree that, in the case of an emergency, the Releasee assumes no responsibility or obligation relative to any cost or expense related to carrying out an emergency procedure and/or emergency transportation for me/my child and I agree to pay for such costs and expenses and shall indemnify and reimburse the Releasee for any such costs or expenses that it incurs.

7.           No refund policy

The Hong Kong Junior Tigers hockey program is a non-profit organization.  We are unable to offer refunds for non-participation.  As a not-for-profit organization, the Junior Tigers budget is based on initial registrations and our most significant cost – ice-time – is paid well in advance of the start of the season. We have a strict no refund policy with exceptions only considered in the event of the complete cancelation of the program or the death or serious injury of a participant rendering him or her unable to participate.

Refunds will only be issued if the China Hockey Group cancels the program. If your child registers for a program and does not meet eligibility (for example age or prerequisites), we will first look at suitable alternatives.  If in doubt, please contact us at info@juniortigershockey.com BEFORE REGISTERING and we can provide guidance on what would best suit your child.  In the event that this is not possible, we will offer a refund (pro rata and less a 10 per cent administration charge).

8.           Photographic Material

I authorize the Releasees to take my photograph, and to use any and all images of me, including video footage, taken at or in connection with CHG Activities. I consent to the use of all such images, photographs and video footage by the Releasees, whether in connection with the Activities or future similar events, without any compensation to me whatsoever. I waive all rights to any photographs, images or video footage taken of me in connection with the Activities, which I acknowledge are the property of the Releasees alone.

9.           Severability

I confirm and agree that if any portion of this Release and Waiver is found to be void and unenforceable, the remainder of the Release and Waiver shall continue in full force and effect.

​In agreeing to the above I am not relying upon any oral or written representations or statements made by the Releasees other than what is set forth above.

 

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS LEGAL AGREEMENT AND I AGREE TO BE BOUND BY ITS TERMS, AND I AM AWARE THAT BY REGISTERING FOR ANY CHG PROGRAMS, CLINICS, SEMINARS, OR EVENTS, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS OR ASSIGNS MAY HAVE AGAINST THE RELEASEES INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.
